The short version

  • Weathard is a free beta. Forecasts can be wrong — your safety and your decisions are your own responsibility.
  • Your spots and alerts are private to you until you choose to share them.
  • When you make a spot public, post to the community feed, or put spots/alerts in a Package that others can download, other people can copy and keep that content — and you can't recall copies once they're downloaded.
  • Be honest and respectful, don't misuse the service, and follow the rules and laws at every spot.

1.Acceptance of these terms

These Terms of Use (“Terms”) are a binding agreement between you and the operator of Weathard (“Weathard”, “we”, “us”). By creating an account, accessing, or using Weathard (the “Service”), you agree to these Terms and to our handling of your data as described in the Data & Privacy section. If you do not agree, do not use the Service.

You must be at least 16 years old, or the age of digital consent where you live, to use Weathard. If you use the Service on behalf of others, you confirm you are authorised to accept these Terms for them.

2.Beta service — provided “as is”

Weathard is an early-stage beta and proof of concept, offered free of charge. It may contain bugs, change without notice, be interrupted, or lose data. The Service and everything in it are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We may modify, suspend, or discontinue any part of the Service at any time.

3.What Weathard does

Weathard lets you save locations (“Spots”), set condition thresholds (“Alerts”) for sports such as surfing, windsurfing, kitesurfing, sailing, paragliding and skiing, view multi-day weather forecasts, share observations in a community feed, and bundle Spots and Alerts into shareable “Packages”. Weathard is an informational and planning tool only. It is not a safety device, a substitute for official weather warnings, or a guarantee of conditions.

4.Safety, forecasts & assumption of risk

Wind, wave, surf, snow and air sports are inherently dangerous and can cause serious injury or death. Weather forecasts are estimates and are frequently wrong.

Forecast, marine, thermal, snow and travel-price data are supplied by third parties and computed models. They may be inaccurate, incomplete, delayed or unavailable. You must not rely on Weathard as your sole source for any decision affecting your safety.

You are solely responsible for deciding whether and how to go out, for assessing conditions in person, for your own skill, fitness and equipment, and for obeying all local laws, access rules, right-of-way conventions and posted restrictions at each Spot. You knowingly and freely assume all risksassociated with your activities. To the maximum extent permitted by law, Weathard is not liable for any injury, death, loss or damage arising from your use of the Service or your activities.

5.Your account

You are responsible for keeping your login credentials secure and for all activity under your account. You may sign in using a third-party provider (such as Google); their terms and privacy practices also apply. Tell us promptly of any unauthorised use. You may delete your account at any time; some records may persist as described in Content you create.

6.Content you create & who owns it

You keep ownership of the Spots, Alerts, descriptions, photos, insights, comments and other content you create (“Your Content”). While something is private, it is visible only to you (an Alert, or an insight on a private Spot, stays yours alone).

However, the moment you choose to make a Spot public, post to the community feed, or include Spots/Alerts in a Package that you publish, share, or make available for others to download, you grant Weathard and other users a worldwide, non-exclusive, royalty-free, perpetual and irrevocable licence to host, copy, display, distribute, and let other users import and create their own copies of that content within the Service.

Downloaded copies are no longer under your control. When another user imports a Package or copies your public content, the copy they receive becomes theirs to keep and use. You can later edit, unpublish or delete your original — but doing so does not recall, alter or delete copies others have already downloaded, and you no longer own or control those copies. Do not publish or package any content you are not willing to give up control of in this way.

You represent that Your Content is yours to share, does not infringe anyone's rights, and does not disclose private property access or anything unlawful. You are responsible for Your Content.

7.Packages & marketplace

You may only package Alerts and Spots that you created. Packaging a Spot makes it public (see above). Payments are not yet available— all Packages are currently offered free of charge; any “paid” labelling is a placeholder for a future feature and no purchase or payment is processed. If and when paid Packages launch, additional terms (including fees, taxes and payouts) will apply and will be presented before any transaction.

8.Acceptable use

You agree not to:

  • break the law, infringe others' rights, or post others' copyrighted material without permission;
  • harass, abuse, impersonate, or post misleading, dangerous or deceptive content in the community feed;
  • scrape, bulk-download, resell, or overload the Service, or attempt to reverse-engineer, probe or bypass its security;
  • misuse the forecast, marine, thermal, snow or travel data beyond your personal, non-commercial planning; or
  • upload malware or interfere with other users' access.

We may remove content or suspend accounts that breach these Terms.

9.Third-party data & services

Weather and marine forecasts are powered by Open-Meteo; travel-price estimates, where shown, come from third-party travel data providers; hosting, authentication and infrastructure are provided by services such as Supabase and Vercel. These providers have their own terms, and their data is provided without warranty. Prices and forecasts shown are indicative and may change or be unavailable.

10.Weathard's intellectual property

The Weathard name, logo, design, and the software behind the Service belong to us and are protected by law. These Terms do not grant you any right to our branding or code beyond using the Service as intended.

11.Data & privacy

We collect and process only what the Service needs to work:

  • Account data — your email, and any name or avatar you provide or that your sign-in provider shares.
  • Your Content & settings — the Spots, Alerts, home location, unit preferences, insights and comments you create.
  • Technical data — basic logs and session information needed to operate and secure the Service.

We use this to provide the Service (including sending you condition notifications), to keep it secure, and to improve it. We share data with the infrastructure and forecast providers listed above only to run the Service. We do not sell your personal data. Content you choose to make public or package is shared as described in Content you create.

You may access or delete your account data by deleting your account or contacting us. Because Weathard is a beta, please do not store anything sensitive you cannot afford to lose. Note that public content and copies others have downloaded may remain after you delete your account.

12.Limitation of liability

To the maximum extent permitted by law, Weathard and anyone involved in creating or operating it will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, or goodwill, or for personal injury, death or property damage, arising from or related to your use of (or inability to use) the Service — even if advised of the possibility. Where liability cannot be excluded, our total liability to you is limited to the greater of the amount you paid us to use the Service (which, during the free beta, is zero) or USD 50.

13.Indemnification

You agree to indemnify and hold Weathard harmless from any claims, losses or expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your activities, or your breach of these Terms or of anyone's rights.

14.Suspension & termination

You may stop using Weathard and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or its users. Sections that by their nature should survive termination — including content licences for already-shared content, disclaimers, and limitation of liability — continue to apply.

15.Changes to these terms

We may update these Terms as the Service evolves. When we do, we'll change the “last updated” date above and, for material changes, make reasonable efforts to notify you. Continuing to use Weathard after changes take effect means you accept the updated Terms.

16.Governing law & contact

These Terms are governed by the laws of [your country/state of residence], without regard to conflict-of-law rules, and the courts there have exclusive jurisdiction, to the extent permitted by any mandatory consumer-protection rules that apply to you.
